Limited Warranty
LUMACROSS™ BULB, LUMACROSS CRUCIFIX BULB, LUMACROSS GLASS LAMP AND LUMACROSS TRAPEZOIDAL LAMP ONE-YEAR LIMITED WARRANTY.Subject to the terms and conditions in this LIMITED WARRANTY, Inner Lighting LLC (IL), warrants that the LumaCross Bulb, LumaCross Crucifix Bulb, LumaCross Glass Lamp and LumaCross Trapezoidal Lamp, (collectively, the “Product”) purchased directly from IL or an authorized reseller, will be free from defects in material and workmanship for a period of One (1) Year from the date of purchase (the “Warranty Period”). The Product is warranted for indoor use only and the warranty is void if the Product is not installed, operated, or maintained in accordance with the National Electric Code (NEC); the Standards for Safety of Underwriters Laboratories, Inc. (UL); and any specific instructions supplied by Inner Lighting for the installation, operation and maintenance of the Product. This warranty does not apply when damage from mechanical, physical, electrical, water or abuse results in causing the malfunction. Deterioration of lamp finishes or other parts due to time or exposure to salt air, sunlight, and corrosive cleaning products are specifically exempt and excluded from this warranty coverage. Inner Lighting shall have the final determination of when such exclusions apply.
If the Product fails during the Warranty Period, return the Product with proof of purchase to: Agora, LLC. 3401 Nevada Ave, N Minneapolis, MN 55427. Upon receipt of the returned Product and determination that its failure is covered under this LIMITED WARRANTY we will, at our option, either provide a replacement Product or a Refund of your purchase price. Any cost related to removal/return of the Product is your expense.
YOUR SOLE AND EXCLUSIVE REMEDY WITH RESPECT TO ANY CLAIM OR DAMAGE ARISING OUT OF, OR IN CONNECTION WITH YOUR PURCHASE AND USE OF THE PRODUCT, IS LIMITED TO REPLACEMENT OF THE PRODUCT OR REFUND OF THE PURCHASE PRICE YOU PAID, AT THE SOLE DISCRETION OF INNER LIGHTING LLC, PROVIDED, HOWEVER, INNER LIGHTING SHALL HAVE NO LIABILITY WHATSOEVER TO YOU UNLESS YOU HAVE FULLY COMPLIED WITH THE REQUIREMENTS OF THIS WARRANTY, THE PRODUCTS ARE FOUND TO BE DEFECTIVE BY INNER LIGHTING AND YOU HAVE PAID FOR THE PRODUCTS IN FULL.
INNER LIGHTING EXPRESSLY DISCLAIMS ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE AND MAKES NO OTHER WARRANTIES TO YOU, EXPRESS OR IMPLIED, EXCEPT AS SPECIFICALLY PROVIDED IN THIS LIMITED WARRANTY. UNDER NO CIRCUMSTANCES SHALL INNER LIGHTING BE LIABLE TO YOU FOR ANY PUNITIVE OR EXEMPLARY DAMAGES OR ANY CONSEQUENTIAL, INCIDENTAL, INDIRECT, OR SPECIAL DAMAGES (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF USE, PROFITS, REVENUE OR BUSINESS) ARISING FROM, OR IN ANY WAY RELATED TO, THE SALE, USE OF, OR INABILITY TO USE THE PRODUCT. THIS EXCLUSION SHALL APPLY REGARDLESS OF WHETHER SUCH DAMAGES ARE SOUGHT BASED ON BREACH OF CONTRACT, BREACH OF WARRANTY, NEGLIGENCE, STRICT LIABILITY IN TORT, OR ANY OTHER LEGAL OR EQUITABLE THEORY.
Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you. This warranty gives you specific legal rights and you may also have other rights which vary from state to state.
